Terms of Use
Last updated
These terms are an agreement between you and Board Game Metrics (“we”, “us”), an app made and run by an independent developer in New South Wales, Australia. They apply to the Board Game Metrics app on iPhone and Android and to this website. By creating an account or using the app, you agree to them. If you don’t agree, please don’t use the app.
We’ve tried to write them plainly. Where they say “you can” or “we will”, they mean it.
The app
Board Game Metrics keeps a record of the board games you play: who played, who won, the scores, and the games you own or want. From that it shows statistics and rankings. You can share records with friends and with groups you play in.
The basic app is free. Plus is an optional paid subscription that adds the features that cost us the most to run, described on the Plus page.
Who can use it
You must be at least 13 years old to use the app. If you are under 18, you need the permission of a parent or guardian, who accepts these terms for you.
Your account
- You sign in with an email address and password, or with Apple or Google. Keep your sign-in details to yourself; you’re responsible for what is done with your account.
- Give us accurate details, and keep your email address current so you can recover your account.
- One account is for one person.
- You can delete your account at any time in the app (see Delete your account).
What you put in the app
It stays yours
The sessions, scores, notes, group names, pictures and other things you add (“your content”) belong to you. You give us permission to store, copy and show your content only so that the app can work: to keep it for you, back it up, and show it to the people you share it with — your friends, the members of a group, and the players tagged in a session. We don’t sell your content or use it for advertising.
Other people in your records
When you log a game you may add people by name, including people who don’t use the app (“guest players”). Only add people you actually play with, use names they’d be comfortable with, and remove someone if they ask you to. Other users who you tag in a session will see that session.
What you must not post
Don’t put anything in the app that is unlawful, abusive, harassing or hateful, that infringes someone else’s rights (including their privacy or copyright), or that you don’t have the right to share. We may remove content that breaks these rules.
Friends and groups
- Friends see your name, handle and picture, and the sessions you’ve played together.
- Groups are run by their owner, who can invite and remove members and give other members admin rights. Everything logged in a group is visible to its members. If you leave a group, the sessions already logged there stay in the group’s history, with your name on them.
- Hosting a group needs Plus. The owner’s subscription covers the whole group, so members can log games in it for free. If the owner’s Plus ends, the group becomes read-only for everyone until it is renewed or handed to another member with Plus. Nothing in it is deleted.
Plus
Buying Plus
Plus is sold through the Apple App Store or Google Play, using the account you have with them. The price, the billing period (monthly or yearly) and any free trial are shown in the app and on the store before you confirm, in your local currency and including tax. Apple or Google takes the payment, and their terms of sale apply to it as well as these terms.
Renewal
Plus renews automatically at the end of each period, at the then-current price, unless you turn off auto-renewal at least 24 hours before the period ends. The store charges your account within the 24 hours before renewal. If a free trial is offered and you don’t cancel at least 24 hours before it ends, the trial turns into a paid subscription.
If we raise the price, the store tells you in advance and, where the law or the store requires it, asks you to agree before you are charged the new price.
Cancelling
Deleting the app, or your Board Game Metrics account, does not cancel the subscription. Cancel it with the store:
- iPhone or iPad: Settings → your name → Subscriptions → Board Game Metrics.
- Android: Google Play → your profile picture → Payments & subscriptions → Subscriptions → Board Game Metrics.
When you cancel, Plus stays on until the end of the period you’ve paid for.
Refunds
Refunds are handled by the store you paid: request one from Apple or Google Play. This doesn’t limit your rights under the Australian Consumer Law or the consumer laws of your country (see section 11).
When Plus ends
When your subscription ends, the Plus features stop, but nothing you made with them is deleted: your groups and their history, rankings and photos become read-only, and you can still see them and delete them. They come back to life if you subscribe again. Plus is personal to your account: it can’t be transferred to another user, and it isn’t shared through Apple’s Family Sharing or a Google Play family group.
Game information from BoardGameGeek
Game names, pictures and details come from BoardGameGeek. Board Game Metrics is not affiliated with or endorsed by BoardGameGeek. Their information is provided as it is; it may be incomplete or wrong, and the pictures belong to their owners.
Using the app fairly
Don’t misuse the app or the services it runs on. In particular, don’t:
- try to get into accounts or data that aren’t yours, or get around the limits of your plan;
- scrape, copy or resell data from the app, or use automated tools against it;
- interfere with the app, overload it, or try to find and exploit weaknesses (if you find one, please tell us at support@boardgamemetrics.com);
- use the app to break the law or to harm other people.
Changes and availability
We keep improving the app, so features may change, and occasionally something will be removed. We’ll try to keep the app available, but it may sometimes be down for maintenance or for reasons outside our control. If we ever decide to shut Board Game Metrics down, we’ll tell you at least 60 days ahead, give you a way to export your records, and stop charging for Plus.
Ending your use
You can stop using the app and delete your account whenever you like. We may suspend or close an account that seriously or repeatedly breaks these terms, after warning you where it is reasonable to. If we close your account without a good reason under these terms, we’ll refund any Plus time you’ve paid for and not used.
Your consumer rights and our liability
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or under the consumer protection laws of the country you live in, that can’t lawfully be excluded. Under the Australian Consumer Law, our services come with guarantees that can’t be excluded.
As far as the law allows:
- the app is provided “as is”, and we don’t promise it will be free of errors or always available;
- we aren’t liable for losses that weren’t reasonably foreseeable, or for indirect losses;
- where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.
Apple and Google
If you use the app on an Apple device, Apple’s Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple or Google. Apple and Google aren’t responsible for the app or its content, have no obligation to provide support or maintenance for it, and aren’t responsible for any claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms, for example when we add features or the law changes. We’ll change the date at the top, and if a change matters, we’ll tell you in the app or by email before it takes effect. If you keep using the app after that, the new terms apply; if you don’t agree, you can delete your account and cancel Plus.
The law that applies
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales can hear any dispute. If you live outside Australia, you keep the protection of the mandatory laws of your country, and you can bring a claim in your own courts where those laws allow it.
Before going to court, please talk to us — most problems can be sorted out by email.
